Welcome to Backra AI ("Backra", "we", "us", or "our"). By accessing or using our website, applications, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. The Service
Backra is an AI-powered tool that processes user-uploaded product photographs to generate background-removed images and lifestyle scene compositions. The Service is provided on a credit-based usage model.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
3. Accounts
To use most features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Credits and Payments
- Credits are required to process images. New users receive a limited number of free credits on signup.
- Credits may be purchased through our payment processor (Stripe) in pre-defined packs at the prices listed on the Service.
- Credits are non-transferable and have no monetary value outside the Service.
- Purchased credits do not expire unless otherwise stated at the time of purchase.
- Pricing may change at any time, but changes will not affect credits already purchased.
5. User Content
You retain all rights to the images you upload ("User Content"). By uploading User Content, you grant Backra a limited, non-exclusive, royalty-free license to process, store, and display your User Content solely for the purpose of providing the Service to you.
You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your use of the Service does not infringe the rights of any third party.
6. Acceptable Use
You agree not to:
- Upload content that is illegal, infringing, defamatory, obscene, or harmful;
- Use the Service to generate content depicting real persons without their consent;
- Attempt to reverse-engineer, decompile, or extract the underlying models or code;
- Use automated means to access the Service in a manner that exceeds reasonable use;
- Resell or redistribute the Service without our written permission.
7. Generated Output
You own the output images generated from your User Content, subject to the underlying AI provider terms (where applicable). Backra makes no warranty regarding the originality, accuracy, or commercial suitability of generated outputs.
8. Intellectual Property
The Service, including its branding, design, and software, is owned by Backra and protected by intellectual property laws. Nothing in these Terms grants you any right to our trademarks or branding.
9. Service Availability
We strive to keep the Service available but do not guarantee uninterrupted operation. We may suspend or discontinue the Service, in whole or in part, at any time without prior notice.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, unused credits are forfeited unless required otherwise by applicable law.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Backra and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability shall not exceed the amount you paid to Backra in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold Backra harmless from any claims, damages, or expenses arising from your User Content, your use of the Service, or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of Greece, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of Athens, Greece.
